While state unencumbered lands are generally open to the public, there are rules that prohibit disorderly conduct, the use of alcohol while on the premises and use of any audio devices “in a manner and at times which creates excessive noise,” according to DLNR. Battles over beach access between residents and wealthy hotel and landowner giants have become a flashpoint exacerbated by the pandemic. Maui County has been buckling under the weight of record-high home prices, historic low housing inventory and higher out-of-state resident home purchases than in previous years. And the Aloha State that was initially shut down to most visitors reopened to a faster-than-expected resurgence in domestic travelers despite several subsequent waves of COVID-19. Whether the public has the right to the pill box overlooking the cliffs is still in question and officials are looking into the rules governing the easement and unencumbered land. Yantis, though, countered the claims Wednesday evening, saying that Nishiki is painting him in a poor light and that he’s never blocked or discouraged access to Cliff House.
Staying true to its origins, today the Cliff House is one of Maui’s most coveted locations to entertain family and friends. Jump ahead to 1978, when the Kapalua Bay Hotel was built on land behind the Cliff House. The hotel was home to what was then called the Kapalua Wine Symposium. But Yantis said the ladder was cut about a year ago because “it was a liability.” He also said it didn’t have a permit and he was trying to obtain a county Special Management Area permit for other home work, so it was removed.
In the evening, guests can savor the panoramic views to Molokai as the sun slips below the horizon and wait for the ‘green flash’ as they bid the night adeu on the lanai with a toast among the stars. Sometimes, entertainment is provided au naturale by, say, a sea of colorful kiteboarders just off of the bay, or humpback whales swimming by. Its close proximity to the water activities of Kapalua Bay and uninterrupted sunset views makes this a truly remarkable and unique location.

The Cliff House accommodates events from 40 guests for a cocktail reception or up to 28 guests for sit down dinner. This premier venue offers floor-ceiling windows that frame the spectacular ocean views. DLNR said any land uses in the conservation district, such as signs, kiosks and guard shacks, would have required a permit per Hawaiʻi law.
Yantis more recently erected signs that refer to “Namalu Bay Nature Preserve” and ask people to enjoy the sounds of nature. “Music, stereos and boomboxes are strictly prohibited,” according to the signs. Typically the shoreline is managed by the county (onshore), the state (seaward of shoreline or high-water mark) and the federal government (into the water). The department on Tuesday added that violations on unencumbered land carry administrative penalties that can result in high fines and that DOCARE officers will be checking and monitoring the area for compliance. The homeowner, Jonathan Yantis, bought the home above the cliffs for $24 million in December 2020. The Cliff House was originally built in 1940, and was used as a gathering location for plantation staff and celebrations.

A popular spot for swimming and cliff jumping, Hawea Point this weekend also became a meeting place for hundreds of people to stand together in solidarity against alleged actions by a neighboring mansion owner to control access to the area.
